The Ohio Department of Developmental Disabilities (DODD) will host a public hearing Thursday, February 9 at 10 a.m. to gather input on a proposed new rule, 5123:2-9-03, Home and Community-Based Services Waivers - Limits on Number of Hours an Independent Provider May Provide Home and Community-Based Services in a Work Week. This proposed rule is in response to the U.S. Department of Labor Home Care Final Rule that applies minimum wage and overtime protections to domestic service workers, including those who provide services to individuals enrolled in Medicaid Home and Community-Based Services (HCBS) waivers. It places a limit on the number of hours an independent provider may provide HCBS in a work week, and establishes a process and the circumstances under which the limit may be exceeded.
Time and Location of Hearing
This hearing will be held in the Lobby Hearing Room of the Rhodes State Office Tower, located at 30 East Broad Street, Columbus, 43215. It will begin at 10 a.m., and continue until all persons in attendance have an opportunity to testify.
